1. Introduction
NurseCenter (Pty) Ltd ("NurseCenter", "we", "us", or "our") is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform, in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and other applicable South African legislation.
2. Responsible Party
NurseCenter (Pty) Ltd is the responsible party for personal information processed through our platform. You may contact our Information Officer at info@nursecenter.co.za with any privacy-related queries or complaints.
3. Information We Collect
We collect the following categories of personal information: (a) Identity information — full name, date of birth, identity number or passport number; (b) Contact information — email address, phone number, physical address; (c) Professional information (Caregivers only) — SANC/HPCSA registration number, qualifications, work history, professional indemnity insurance details; (d) Financial information — payment card details (processed and stored by our payment partner, PayGate — we do not store full card numbers), bank account details for payouts; (e) Usage data — IP address, browser type, pages visited, booking history; (f) Health information — care needs and medical information provided by Clients to facilitate care bookings (treated as special personal information under POPIA).
4. How We Use Your Information
We process your personal information to: (a) create and manage your account; (b) facilitate bookings between Clients and Caregivers; (c) process payments and payouts; (d) verify Caregiver qualifications and identity; (e) send booking confirmations, reminders, and service updates; (f) respond to queries and provide customer support; (g) improve our platform through analytics; (h) comply with legal and regulatory obligations; and (i) detect and prevent fraud or misuse of the platform.
5. Lawful Basis for Processing
We process your personal information on the following grounds under POPIA: (a) contractual necessity — to fulfil our service agreement with you; (b) legal obligation — where required by law; (c) legitimate interest — for platform security, fraud prevention, and service improvement; and (d) consent — for marketing communications and the processing of special personal information (health data). You may withdraw consent at any time without affecting the lawfulness of prior processing.
7. Retention of Information
We retain your personal information for as long as your account is active or as needed to provide services. After account closure, we retain records for a minimum of 5 years to comply with financial regulations. Health-related information is retained in accordance with applicable healthcare record-keeping requirements. You may request deletion of your account and personal information, subject to our legal retention obligations.
8. Security
We implement appropriate technical and organisational measures to protect your personal information against unauthorised access, disclosure, alteration, or destruction. These include TLS encryption in transit, encrypted data at rest, access controls, and regular security reviews. However, no transmission over the internet is 100% secure, and we cannot guarantee absolute security.
9. Your Rights Under POPIA
As a data subject under POPIA you have the right to: (a) be notified that your personal information is being collected; (b) access the personal information we hold about you; (c) request correction of inaccurate or outdated information; (d) request deletion of your personal information, subject to legal obligations; (e) object to the processing of your information; (f) submit a complaint to the Information Regulator of South Africa (inforeg.org.za) if you believe your rights have been violated. 11. Children's Privacy
Our platform is not directed at children under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, please contact us immediately and we will take steps to delete it.
12. Cross-Border Transfers
Some of our service providers (including cloud infrastructure) may be located outside South Africa. Where personal information is transferred cross-border, we ensure adequate protection is in place as required by section 72 of POPIA, including data processing agreements with appropriate safeguards.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated by email or in-app notification at least 14 days before they take effect. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the platform after the effective date constitutes acceptance of the updated policy.
