1. Acceptance of Terms

By accessing or using the NurseCenter platform (website, mobile application, or any related service), you agree to be bound by these Terms & Conditions. If you do not agree, you must discontinue use immediately. These terms apply to all users, including clients, caregivers, nurses, and visitors.

2. Description of Services

NurseCenter is a technology platform that connects individuals ("Clients") seeking home nursing or caregiving services with qualified healthcare professionals ("Caregivers"). NurseCenter facilitates the booking process, payment, and communication between parties but is not itself a healthcare provider. All clinical judgements and decisions remain the responsibility of the individual Caregiver.

3. Eligibility

You must be at least 18 years of age to create an account. By registering, you confirm that all information you provide is accurate, current, and complete. NurseCenter reserves the right to suspend or terminate accounts where information is found to be false or misleading.

4. Client Obligations

Clients agree to: (a) provide an accurate description of care needs at the time of booking; (b) ensure a safe working environment for the Caregiver; (c) treat all Caregivers with dignity and respect; (d) pay all applicable fees as agreed at the time of booking; and (e) not engage or pay Caregivers directly outside of the NurseCenter platform during or within 12 months after a booking.

5. Caregiver Obligations

Caregivers agree to: (a) maintain valid SANC, HPCSA, or relevant professional registration at all times; (b) hold current professional indemnity insurance; (c) provide accurate qualification and experience information; (d) arrive on time for confirmed bookings; (e) adhere to all relevant health and safety regulations; and (f) keep all patient information strictly confidential in accordance with applicable law.

6. Bookings & Cancellations

Bookings are confirmed only upon receipt of payment. Cancellations made more than 24 hours before the scheduled booking start time are eligible for a full refund. Cancellations within 24 hours are subject to a cancellation fee of 50% of the booking value. No-shows (failure to be present without cancellation) are non-refundable. NurseCenter reserves the right to cancel a booking if a suitable Caregiver is unavailable, in which case a full refund will be issued.

7. Payments & Fees

All payments are processed securely through our payment partner, PayGate. Clients are charged at the time of booking confirmation. NurseCenter deducts a platform service fee from each booking; the remainder is remitted to the Caregiver on the next scheduled weekly payout (every Friday). All prices are quoted in South African Rand (ZAR) and include VAT where applicable. NurseCenter reserves the right to update pricing with 14 days' notice.

8. Caregiver Verification

NurseCenter undertakes reasonable steps to verify Caregiver qualifications, identity, and professional registration. However, NurseCenter does not guarantee the accuracy of information provided by Caregivers and is not liable for any misrepresentation. Clients are encouraged to review Caregiver profiles, ratings, and reviews before confirming a booking.

9. Limitation of Liability

To the maximum extent permitted by South African law, NurseCenter shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our platform or the provision of care services. Our total liability for any claim shall not exceed the amount paid for the specific booking giving rise to the claim. NurseCenter is not liable for the clinical outcomes of any care provided.

10. Intellectual Property

All content on the NurseCenter platform — including logos, text, graphics, and software — is the property of NurseCenter or its licensors and is protected by South African and international intellectual property law. You may not reproduce, distribute, or create derivative works without prior written consent.

11. Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using NurseCenter you consent to the collection and use of your personal information as described in the Privacy Policy.

12. Termination

NurseCenter reserves the right to suspend or permanently terminate any account, at its sole discretion, for breach of these Terms, fraudulent activity, abusive behaviour, or any other reason deemed necessary to protect the safety and integrity of the platform.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the South African courts.

14. Changes to These Terms

NurseCenter may update these Terms from time to time. We will notify registered users by email or in-app notification at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
